Carolina extends the protection of civil rights by putting restrictions on discrimination of employees based on their personal use of lawful products, military status, sick cell or C trait status and the AID/HIV status of the employee.
To implement “Ban the Box” policies, Carolina’s Governor Roy Cooper signed Order 158 on August 18, 2020 effective November 1, 2020. It basically refers to boxing job applicants for criminal records. North Carolina has joined over 35 states in the attempt to reduce employment barriers for ex-offenders. Employers are prohibited from asking expunged criminal history questions from applicants and application are allowed to omit expunged entry in the application process. In fact, North Carolina is working on limiting the extent of the state’s licensing boards in granting or denying licenses for professionals based on their criminal records.
The Labor Laws in Carolina for hours and wage protection are extensive. North Carolina Wage and Hour Act (WHA) for instance, requires a 30 minute break to be given after 5 hours of work for those under the age of 16. It does not however, make it mandatory to provide meal break for employees older than 16.
Pay Day Requirements is also covered by WHA, which incorporates the frequency and manner of payment, the minimum wage and also overtime pay. Carolina employees have an option to choose the frequency of the payment and whether it is going to be on a monthly, bi-weekly, weekly or daily basis. Both federal and Carolina’s law requires employers to pay overtime equal to 1.5 times an employee’s normal rate.
