Massachusetts: An Employee-Friendly State

Massachusetts Employment Law on Use of Criminal Records
Massachusetts is said to have one of the strongest protections for applicants with a criminal record. It recently passed a provision, effective since October 13, 2018, “ban the box.” This provision prohibits employers from asking for criminal records in the initial written application process of applicants. Questions can be asked about criminal history when the interview stage is reached but that has limitations as well.
Massachusetts Law on Discrimination
Massachusetts follows the federal law in terms of discrimination and fair practice and provides the same service-member rights and privileges as Uniformed Services Employment and Reemployment Rights Act (USSERA). In addition to the federal law prohibitions on discrimination, Massachusetts prohibits discrimination based on marital status, insurance status, and criminal record.

The Consolidate Omnibus Budget Reconciliation Act (COBRA) is a federal law that allows many employees to continue reaping health insurance benefits even after the employment ends under certain conditions. Massachusetts has adopted its own version of the law, referred to as the “mini-COBRAs,” that allow employees to continue with their coverage up to a period of 18 months.
Massachusetts Paid Family and Medical Leave (PFML) law, embedded January 1, 2021, allows for covered individuals to use paid family and medical leave for the following reasons:
- To bond with a child during the first year after child birth or adoption
- To care for a family member who is a covered service member
- To managers affairs if a family member’s active on duty in Armed Forces
- To care for individuals own serious health condition.
The option to utilize the paid family leave to care for a family member with severe health condition would become available on July 1, 2021. In addition to this, most Massachusetts employees have the right to earn 40 hours of sick leave per year.
Massachusetts has its book of laws called the Blue Laws that control hours of operation for certain businesses and require to pay extra compensation, known as “premium pay,” on Sundays and other legal holidays. As of January 2021, employees must be paid at 1.2 times their regular rate for any time worked on Sundays, New Year’s Eve, Memorial Day, Independence Day with Juneteenth Independence Day being the latest addition to it.
