Georgia State has specific laws the employers have to comply with regarding consumer reports, criminal background checks, or even a driver’s license check.

Georgia law requires employers who employ three or more employees to provide workers’ compensation coverage for their employees. Similar to this law, there are other state-specific laws HR professionals must be aware of. 

Employers must report re-hires, or employees who return to work after 60 days of being laid off, furloughed, separated, granted a leave without pay, or terminated from employment. Employers must also report re-called employees, anyone, who remains on the payroll during a break in service or gap in pay and then returns to work. This includes teachers, substitutes, seasonal workers, etc. 

Georgia Employment Laws

Employers located in Georgia or hiring in Georgia must observe the Federal Fair Credit Reporting Act (FCRA) along with other federal and state employment laws.

FCRA puts forth one of the most important guidelines for regulating hiring practices. It basically prevents against privacy invasion and ensures fairness of employee information through set standards laid down in terms of information collection and use. Different states have varied laws for governing the use of criminal records.

Things you need to know as a Hiring Manager in Georgia State

An extension of the FCRA was approved by Governor Nathan Deal on February 12, 2015 to implement statewide Ban the Box hiring policies. The policy stipulates inquiries done on applicant’s criminal history in the initial stages of applicant’s employment process cannot be made.

Second Chance Law, effective January 1, 2021 expands on the background screening laws by allowing Georgia residents to seal and restrict records for felony convictions and certain offences. These records cannot be then viewed by employers when performing background checks. In addition to this, the new bill removes age limitations for offences. Up to 2 convictions can be sealed from the record by individuals. Removal of pardoned offenses can also be requested.

Georgia law does allows employers to obtain criminal records of applicants with the written consent or applicant’s fingerprints from the Crime Information Center of the state. Probation is not considered conviction, hence, disqualification based on probation once it is complete is not allowed. In the case where an applicant is not hired based on criminal record, the employer must disclose all information in the record to the applicant with reasoning for the decision.

Georgia General Assembly also enacted another bill related to wage and hour laws. A cap has been placed on the amount that can be garnished if you have a student or education loan. The limit is 15 percent of your weekly disposable earnings.

Did you know that the FLSA Act establishes minimum wage, overtime pay, record keeping, and child labor standards. Although the federal minimum wage is $7.25 per hour, Georgia’s minimum wage is $5.15 per hour. But in order to adhere to the Fair Labor Standard Act (FLSA) it is best to follow federal minimum wage in this case.

The Consolidated Omnibus Budget Reconciliation Act (COBRA) in Georgia requires for employers with 20 workers and under, to provide for optional continuation COBRA coverage to their employees.
